Welcome to EV Elite Mods. EV Elite Mods LLC, doing business as EV Elite Mods, operates this store and website. The terms “we,” “us,” and “our” refer to EV Elite Mods LLC.

EV Elite Mods provides this website, including all related information, content, features, tools, products, and services, to provide customers with a convenient shopping experience collectively referred to as the “Services.” Our store is powered by Shopify.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using our Services.

We do not guarantee that the appearance of a product will be identical to photographs, digital renderings, videos, prototypes, or other representations displayed through the Services.

We reserve the right to discontinue a product, limit available quantities, restrict sales to certain customers or locations, or refuse an order where permitted by law.

Vehicle Compatibility and Product Selection

Customers are responsible for reviewing all product descriptions, measurements, compatibility information, supported vehicle years, vehicle models, trims, installation instructions, warnings, and selected product variations before placing an order.

Customers must verify that the selected product is appropriate for their specific vehicle, configuration, intended location, and intended use.

Compatibility may vary based on vehicle year, model, trim, production date, regional configuration, factory updates, aftermarket modifications, or manufacturer design changes.

EV Elite Mods products are aftermarket accessories. They are not manufactured, sponsored, approved, licensed, or endorsed by any vehicle manufacturer unless expressly stated otherwise.

References to vehicle manufacturers, vehicle models, product names, or trademarks are used only for identification and compatibility purposes.

Product Installation and Safe Use

Customers are responsible for installing and using products safely, correctly, and in accordance with all product instructions, warnings, vehicle manufacturer guidance, and applicable laws.

Products must not be installed or used in a manner that:

Obstructs the driver’s view
Interferes with vehicle controls
Interferes with cameras, sensors, or driver-monitoring systems
Interferes with airbags or other safety equipment
Distracts the driver
Damages vehicle surfaces, wiring, trim, or components
Creates an unsafe condition
Violates applicable laws or vehicle manufacturer requirements

Our products are not intended to defeat, bypass, disable, obstruct, or interfere with any vehicle safety system, driver-monitoring system, warning system, or driver-attention requirement.

The driver remains fully responsible for operating the vehicle safely, remaining attentive, following applicable laws, and supervising any driver-assistance features.

Customers should discontinue use immediately if a product becomes loose, damaged, deformed, improperly positioned, excessively heated, or otherwise unsafe.

Installation and use are performed at the customer’s own risk, except to the extent that liability cannot legally be excluded.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase the selected products.

EV Elite Mods reserves the right to accept, decline, limit, modify, or cancel an order where permitted by law. An order is not accepted until we confirm acceptance and successfully process the required payment.

We may refuse or cancel an order for reasons including:

Pricing or listing errors
Suspected fraud
Payment authorization problems

You are responsible for selecting the correct product and variation.

Order Cancellations

Cancellation requests must be submitted within one hour after the order is placed.

A cancellation request is not guaranteed until it has been reviewed and approved by EV Elite Mods.

Orders that have already entered production, processing, fulfillment, or shipping may not be canceled.

Orders that have already shipped must follow our Return and Refund Policy.

Returns and Refunds

Purchases are eligible for returns, exchanges, replacements, or refunds only as described in our Return and Refund Policy.

You represent and warrant that purchases are made for lawful personal, household, or authorized business use and not for unauthorized resale, fraudulent export, or other prohibited activity.

Charges associated with your order will be honored by your payment provider.
You will pay all valid charges associated with your purchase.

We may use third-party payment processors. Your payment information may be processed according to the payment provider’s applicable terms and privacy policies.

SECTION 5 — SHIPPING AND DELIVERY

Processing dates, shipping dates, and delivery dates are estimates and are not guaranteed.

Delivery may be delayed because of:

Customs processing
Incorrect or incomplete addresses
Holidays

Supply interruptions
Natural disasters
Government actions
Events outside our reasonable control

EV Elite Mods is not responsible for carrier delays or other delays outside our reasonable control.

Customers are responsible for providing an accurate and complete shipping address.

EV Elite Mods is not responsible for delays, failed deliveries, additional fees, or losses caused by an inaccurate, incomplete, outdated, or undeliverable address supplied by the customer.

Contact us as soon as possible if you discover an address error. We cannot guarantee that an address can be changed after an order enters fulfillment.

Customers should promptly contact us if an order:

Arrives damaged
Appears to be missing products
Contains an incorrect product
Is marked delivered but cannot be located

When permitted by law, risk of loss passes to the customer upon confirmed delivery to the provided address.

Nothing in this section limits rights that cannot legally be waived under applicable consumer-protection laws.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their content, including trademarks, business names, logos, product names, text, graphics, photographs, videos, audio, product designs, digital files, instructions, layouts, and website design, are owned by EV Elite Mods, its affiliates, or its licensors.

EV Elite Mods is powered by Shopify, which enables us to provide the Services to you.

However, purchases and transactions conducted through our store are made directly between you and EV Elite Mods.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of a sale between you and EV Elite Mods, including injury, damage, loss, refund disputes, product performance, fulfillment, or delivery.

To the fullest extent permitted by law, we disclaim implied warranties or conditions including merchantability, merchantable quality, fitness for a particular purpose, durability, title, and noninfringement.

We do not guarantee that:

The Services will always be uninterrupted
The Services will always be secure
The Services will always be error-free
Products will meet every customer’s subjective expectations
A product will be compatible with an incorrectly selected vehicle or variation
Third-party platforms or services will remain available

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the maximum extent allowed by law.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, EV Elite Mods and its owners, officers, employees, contractors, agents, affiliates, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to:

Improper product installation
Product modification
Unsafe product use

Vehicle damage caused by misuse

This limitation applies regardless of whether the claim is based on contract, negligence, tort, strict liability, or another legal theory, even when the possibility of damages was disclosed.

To the fullest extent permitted by law, EV Elite Mods total liability arising from a particular purchase will not exceed the amount paid to EV Elite Mods for the product giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

SECTION 18 — INDEMNIFICATION

Any ambiguity will not automatically be interpreted against the party that drafted the Terms.
